Terms of Service

1. Who You Are Contracting With; Acceptance of Terms

These Terms of Service are an agreement between you and [LEGAL ENTITY], a [ENTITY TYPE, e.g. New York limited liability company] with its principal place of business at [BUSINESS ADDRESS] ("Kechen", "we", "us"). You can reach us at support@kechen.app.

By accessing or using Kechen, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Description of Service

Kechen is a marketplace platform connecting local chefs with customers. We facilitate food ordering, payment processing, and delivery coordination. Kechen is not a restaurant and does not prepare food directly.

3. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You must be at least 18 years old to use the platform. We reserve the right to suspend or terminate accounts that violate these terms.

4. Orders and Payments

All prices are displayed in USD. Each dish has its own per-meal price, shown before you order; your total is the meals in that week's plan plus any delivery fee and applicable sales tax. One-time orders are charged at checkout.

If you choose courier delivery, the courier fee for a trip is charged to your saved payment method when the meal is handed to the courier, separately from your weekly charge.

You authorize us to charge your saved payment method for these amounts. If a charge fails we may retry it and may pause fulfillment until payment succeeds.

5. Subscriptions, Cancellation and Refunds

A Kechen subscription renews automatically every week until you cancel. Each week you are charged for the meals in that week's plan at the prices shown in the app, plus any delivery fee and tax. Subscribers receive 10% off meal prices.

How to cancel: in the app, go to Profile → Subscription → Cancel. You can also email support@kechen.app and ask us to cancel for you.

When charges stop: cancelling stops all future weekly charges. The week you have already paid for is not refunded — those meals are still prepared and delivered, and your subscription ends at the end of that billing week. Cancel before the next weekly charge to avoid being billed for another week.

Refunds: if a meal is not delivered, or arrives in a condition that makes it unusable, contact support@kechen.app within 24 hours of the scheduled delivery. We review each report and issue a refund or credit where warranted. Refunds are returned to the original payment method. Beyond that, payments are non-refundable except where required by law.

6. Chef Terms

Chefs are independent contractors, not employees of Kechen. Chefs are responsible for food safety, accurate menu descriptions, and timely preparation. Kechen retains a platform fee from each transaction.

Chefs additionally accept the Kechen Chef Participation Agreement when they create a chef account; it governs kitchen type, regulatory compliance, food safety, payouts and platform fees. It is available at chef.kechen.app/agreement.

7. Food Preparation and Allergens

Meals are prepared by independent chefs, some of whom cook in home kitchens that are not subject to state restaurant inspection. Ingredient and allergen information is supplied by the chef and may be incomplete, and a kitchen may handle allergens other than those listed. If you have a food allergy or dietary restriction, contact the chef through the app before your meals are prepared and do not rely on the listing alone.

8. Limitation of Liability

Kechen acts as a marketplace facilitator. We are not liable for the quality, safety, or legality of food prepared by chefs. To the maximum extent permitted by law, Kechen shall not be liable for indirect, incidental, or consequential damages arising from your use of the platform.

9. Governing Law

These Terms and any dispute arising out of them or your use of Kechen are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules, and by applicable United States federal law. Nothing here removes any consumer protection you have under the law of the place where you live.

10. Dispute Resolution

Talk to us first. Most problems are solved quickly by email. Before starting any formal proceeding, send a written description of the dispute and the resolution you want to support@kechen.app. We will try to resolve it with you within 30 days of receiving it.

If that does not work. Any unresolved dispute will be handled by [DISPUTE FORUM — e.g. the state and federal courts located in [COUNTY], [STATE], or binding individual arbitration], and you and Kechen each consent to that forum. Either of us may still bring an individual claim in small-claims court where it qualifies.

This section is being finalized with counsel; the bracketed choice above is not yet in force. Until it is filled in, disputes are handled under the governing law named in Section 9 through the informal process described above.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the platform. Continued use after changes constitutes acceptance of the updated terms.
